Whenever you are involved in a motor vehicle accident in Florida and that accident is not your fault, you may be entitled to pursue a diminished value claim. When your vehicle is repaired, the vehicle suffers a dimunition of value. Frankly, this means the vehicle just is not worth what it was before. Under Florida law, these damages are recoverable, meaning you can recover from the at-fault party the difference between the value of your vehicle before the accident, and the value of the vehicle after the accident.
