How Contacting His Lawyer Early On Earns Client in Fall Case $675,000 Part 1

John returned from work on a normal weekday evening. He grabbed his toolbox from his car and began walking along the sidewalk of his apartment complex towards his apartment. The outdoor light which normally lit his path was broken and had not been repaired. As a result, John did not notice a broken section of the sidewalk which had been crushed by a truck backing over it, leaving a deep indentation. As he stepped into it, he was thrown off balance, falling on his toolbox and wrenching his low back.

A week later, John contacted our office, he was suffering from low back pain and had been seen in the emergency room. It was unclear, at this point, whether he had any significant back injury. We retained an engineer who promptly photographed the defective sidewalk and the broken light and had John put the apartment complex on notice of his injury.


Ultimately, John was diagnosed with a herniated lumbar disc. Despite extensive, conservative treatment including physical therapy and epidural steroid injections, his symptoms continued to worsen. Almost a year and a half later, he required back surgery which included fusing two lumbar disks. John's condition was further complicated by an infection in the surgical site which required additional hospitalization and surgeries.

We filed a lawsuit on John's behalf against the apartment complex for their failure to maintain the sidewalk and provide adequate lighting. We successfully settled his fall case for $675,000 two weeks before trial.
