You might want to send a thank you note to the Governor and the Florida Legislature for giving the business lobby a gift this year by making it harder to sue when someone falls at a business, in cases where something was spilled or left on the floor!

It just became harder to prove slip and fall cases as of July 1st. The new rules shift the burden of proof from the business to the victim. Now the injured victim must have proof the business actually knew what was on the floor and failed to exercise reasonable care, which led to the person being injured. Alternatively, the new law does allow the victim to satisfy the proof issue by showing what ever was on the floor had been there so long the business should have known it was there, or by proving it occurred so regularly it was foreseeable.

This is a major change in the slip and fall law. Up until July 1st, there was no requirement in Florida for the injured victim to prove the store or business knew the substance was on the floor, either by actual proof they knew or by evidence showing they should have known. The old law was based on the belief the business was in the best position to act with reasonable care.

This new change makes it more important to gather as much evidence as possible when someone falls on water or some "transitory foreign object" on the floor. It is virtually impossible in most slip and fall cases for the injured person to prove the store actually knew it was there unless some employee admits it.

Most fall cases will be decided on what proof is available, the store "should have known" it was there. That is where evidence about the size of the food or spill, consistency, color, smell, cart tracks or foot prints through it will be important. These things are usually only seen by the victim or someone with them at the time of the fall. Evidence similar things have been frequently seen on the floor of a particular store may be able to satisfy the new law as well.
