In most injury cases, evidence of accidents which have happened before or after the one involved in a client's claim can't be used against them at trial.

However, there are exceptions. In some cases a prior or subsequent accident may be admissible at trial.

One of the mistakes I have written about in my books, "Dangerous Trips to Avoid in Your Fall Case." and "Five Mistakes that Can Wreck Your Florida Accident Case," is the failure of clients to tell their lawyer of other accidents and injuries in which they have been involved.

The last thing a personal injury lawyer wants to learn from the other side is evidence the lawyer had never been told by their client - especially when it involves a prior or subsequent accident or injury.

In a recent case, an injured person had been hurt in a fall. The person had suffered another fall at some entirely different place, after the one involved in his lawsuit. A Florida court allowed the defense to tell the jury about the man's second fall, not to prove he was prone to falling (the real reason they want the jury to hear about it, but not permitted legally), but to prove his physical condition when he fell the second time.

The man lost his case!

Clients must always be truthful with their lawyer, bad things happen when they are not.
